Sir,

I have the honour to refer to the discussions held by representatives of our two govemments concerning the Arrangement between the Government of Denmark and the Government of the Democratic Socialist Republic of Sri Lanka relating to the repatriation of Sri Lankan nationals, who do not or do no longer have the right of residence in Denmark.

In light of the understandings reached in those discussions I have the honour to propose, on behalf of the Government of Denmark, the following to regulate the repatriation of Sri Lankan nationals, who do not or do no longer have the right of residence in Denmark:

1. Both parties accept that Sri Lankan nationals who do not or no longer have the right of residence in Denmark will return in conditions of safety and dignity.

2. Both parties accept that the repatriation referred to in paragraph 1, willl be carried out in a phased manner and in any event not exceed 350 persons for the first year. Both parties will review this number after the lapse of one year from the date of exchange of these letters. Sri Lankan citizens returning home on their valid original Passports issued by the Competent Sri Lankan Authorities will not be counted within this number.

3. The Government of Sri Lanka will accept persons whom the Danish authorities decide to return subject to the availability of acceptable proof that such persons are in fact citizens of Sri Lanka. The Danish authorities shall ensure that the attached questionnaire will be completed to the fullest extent possible in respect of each returnee, induding retumees who refuse to cooperate in this process. In respect of such returnees whose Sri Lankan nationality is established, the Sri Lankan authorities will issue valid travet documents prior to their departure such as a passport or other document of identity as may be determined by the Competent Sri Lankan Authorities.

4. Both parties will consult each other whenever there are compelling circumstances which make it necessary to consider farther measures in the itnplementation of this arrangement.

5. Upon the conclusion of the exchange of letters between the Danish Minister for Foreign Affairs and the Ambassador of the Democratic Socialist Republic of Sri Lanka, the Competent Authorities of the two countries will mutually work out the necessary practical modalities within the framework of this arrangement for its itnplementation.

If this proposal is acceptable to the Govemment of the Democratic Socialist Republic of Sri Lanka, I have the farther honour to suggest that this letter and Your Excellencys letter in reply shall constitute an Arrangement between our two Governments which shall enter into force on the date of Your Excellency's letter in reply.

After a period of two years both parties wiIl consider the further extension of this arrangement.

Acting upon the instructions from my Government, I have the honour to confirm that the contents of Your Excellenxy's letter dated 18 August 1998 are acceptable to the Govemment of the Democratic Socialist Republic of Sri Lanka and that Your Excellency's letter and this letter in reply shall constitute an Arrangement between the two Governments, which shall enter into force with immediate effect.
